Americans react to historic health care decision

CHICAGO (AP) ? The mother of two disabled teens called Thursday's Supreme Court ruling on the health care law wonderful because it bars insurance companies from setting lifetime limits for medical expenses ? a big help to her family.

But a retiree on Medicare called it a "sad day" and worries that the law's new rules coming in 2015 will interfere with treatments doctors can provide.

As Morefield sees it, the health law allowed her son Tucker to die peacefully at home with private health insurance covering his care.

Tucker, one of three triplets with cerebral palsy, was always the most fragile of the siblings, Morefield said. Five years ago, he maxed out the $1 million lifetime limit in his family's policy when he went into respiratory failure and was hospitalized for 12 weeks.

Hitting the lifetime limit meant the insurance company would no longer pay Tucker's medical bills. The state of Illinois picked up the slack through a program for children with special health care needs. But the program put strict limits on certain medical supplies, leading the family to wash and reuse equipment meant for single use.

Tucker's coverage was reinstated in 2011 because the health care law barred lifetime dollar limits on coverage. He lived another 15 months covered by private insurance. At the end, he had doctor visits at home, oxygen and enough pain medication ? all care that Morefield said would have been restricted under the state program.

"It was a blessing for us," Morefield said. "People who've not had the ongoing medical things we've had don't understand."

Morefield reacted to the Supreme Court decision on Thursday, her birthday, with joy. She called it a great gift that will grant her and her husband peace of mind.

"It's wonderful," she said.

Criscuola is worried that a controversial board created by President Barack Obama's health overhaul will ration health care and also dictate treatments to doctors. She has family members with a rare genetic condition that she said requires experimental therapies.

The board, called the Independent Payment Advisory Board, is meant to hold down Medicare costs, beginning in 2015. Republicans are targeting the provision for repeal. Criscuola fears the board's influence will go beyond Medicare and permeate the health care system. The White House has said the board is crucial to holding down costs and is barred by the law from rationing care.

The law also encourages a payment model for hospitals, insurers and doctors called "accountable care organizations," which Criscuola believes also will limit doctors' choices in treating patients.

Criscuola has benefited from a provision in the health care law that provides free annual wellness exams to people with Medicare.

"Do I use it? Yeah. Is the benefit I receive from it more than if I had kept the money I paid into Social Security and Medicare payroll taxes and invested it myself? No. It's considerably less," she said. "Will it be around in 15, 20 years? Probably not."

On Thursday morning, waiting for the news, Veals was watching CNN, which initially reported incorrectly that the law had been overturned. She was tense with worry that she would lose her coverage.

"I'm totally, absolutely right now dazed because they first, initially said it had been overturned," Veals said. "I'm sitting here gasping for breath. ... Now they're saying it's being upheld." She added: "It's a relief."

The expense of her breast cancer treatments led to bankruptcy and foreclosure for her family over a horrific 10-year period. Finally, it cost so much that she could no longer afford health insurance. She and her self-employed husband decided to drop her from the family's insurance plan four years ago to reduce their monthly premiums from $1,700 to $400 a month.

She spent the next 27 months uninsured. Then in 2011 she signed up for insurance made possible by the new law. The program helps people who have been turned away by insurance companies because of pre-existing medical conditions. She now pays $377 a month for her insurance with a $1,000 deductible, meaning she pays that much out of pocket before the coverage starts.

"It has only been a little over a year for me, but I can't tell you the dignity being covered brings," Veals said. "My biggest fear was I would have to beg for help to cover medical bills. Panhandling to pay a doctor's bill ... not my idea of the American Dream."

Though raised as a Republican, Veals said her politics are changing.

"As a conservative, I believed if you can't make your way, you don't get your way. Now I've cost more medically than I will ever be able to make. I've changed my political stance because of this," she said. "It doesn't do our economy any good when we have so many people having to file for medical bankruptcy."

Esch, a father of three, lost his job in November in a layoff his employer said resulted from Obama's health law. He had worked for medical device maker Stryker Corp. for six years. The company announced in November it intended to lay off 1,000 workers worldwide to save money ahead of a 2.3 percent tax on medical devices that starts in 2013.

The tax is meant to help pay for expanding health coverage to uninsured Americans. The Obama administration argues device companies will gain in the long run as more patients become eligible to receive their products because they have insurance. Republicans working to repeal the tax call it a job-killer.

Esch worked half a year as a hospital purchasing agent, at lower pay, before landing another job in the medical device industry. He said he will catch up to his former salary level next year.

"There was hardship in there," Esch said. "I think it's going to be typical of this business for a while as companies attempt to adjust to the increased tax on them."

He blames the tax for the loss of his job, but is grateful for the provision in the health care law that will allow his oldest child, now a college junior, to stay on his insurance until age 26.

Esch said he is pleased the law was upheld, but also that the high court pronounced the penalty for not buying insurance a "tax."

"It adds a word the American people will pay attention to," he said.

Employment: Night security guard at upscale apartment complex

Two years ago, Grimmett had a job with good insurance and a wife with diabetes and other health problems. But then his job, doing plumbing and HVAC work at an Atlanta university, was outsourced and he no longer could cover his wife's medical bills.

His wife had to stop going to the private doctors she was seeing, and her husband tried to get her into care elsewhere. But at other facilities, they encountered paperwork, delays and foot dragging, he said. Her health deteriorated.

"When you don't have insurance, they treat you different," he said.

In January 2011, Mary Grimmett started struggling to breathe and was rushed to Grady Memorial, Atlanta's safety net hospital. She qualified for a program that provides discounted and even free care to uninsured people who qualify. But by that time she had pneumonia as well as a broken ankle that needed surgery and was very sick.

She spent two weeks in the hospital and then died of congestive heart failure ? a complication of her other illnesses. She was 39.

Today, Grimmett has a job, making $25,000 a year, but still has no insurance. Under the new health care law, he will be eligible for a government tax credit to help with the cost of buying private health insurance.

That would reduce his estimated annual premiums for health coverage from $5,054 to $1,726.

He is healthy, but the loss of his wife was a tragic lesson in the importance of coverage, he said. When he heard about the Supreme Court ruling from others at a nonprofit where he was volunteering, he said he felt grateful to Obama for helping the poor.

"He's listening to the voice of Jehovah God," he said. He added: "I'm grateful for the hope and opportunity to have health insurance, not just myself but all people who can't afford health insurance. It's a great thing that has taken place today."

Schreiber's young and healthy, but still had reason to worry about the Supreme Court decision. He works for a small business and is responsible for switching the company to a new health insurance plan. He has found a plan at a reasonable price, but that price won't be locked in until August.

Early Thursday, he was concerned that the price would jump with a confusing decision on the health care law, or if the court overturned it. Like many other Americans, he saw contradictory news reports about the ruling and "my heart dropped."

He repeatedly refreshed the Web pages on his computer screen and, finally, when the ruling became clear, "it was a relief."

The company is among the 30 percent of businesses with fewer than 10 employees that offer health coverage. Small businesses often pay more for insurance than large companies.

Schreiber is hoping his company can qualify for a tax credit made available by the health care law for small businesses that provide health insurance. The tax credit is one of the most popular ideas in the health law, according to polls.

When Ames woke up from ankle surgery, her doctor said her ligament had been in worse shape than he previously thought from previous sports injuries.

"He told me if I had injured it once more, it would likely have torn apart entirely," Ames said. "I may never have fully regained my ability to walk. It's only because I was able to get the operation when I did that I was spared a much more severe, painful and lasting injury."

Ames was able to have the $30,000 surgery because she was covered by her parents' insurance, thanks to a provision in the health care law that lets young adults keep that coverage until they turn 26. Nationally, an additional 3.1 million young people are covered as a result.

She is uncertain whether she will have a job that provides insurance when she turns 26 in October.

But "I'm so relieved I did not just lose my health insurance today," she said.

Colorado Springs fire is state's most destructive on record

COLORADO SPRINGS, Colo. (Reuters) - A fierce Colorado wildfire that has forced the evacuation of some 35,000 people while raging for six days at the edge of the state's second-most populous city has destroyed 346 homes, Mayor Steve Bach said on Thursday, citing preliminary damage reports.

If those figures hold up, the tally of lost homes in and around Colorado Springs would make the so-called Waldo Canyon Fire the state's most destructive on record, surpassing the 257 homes consumed in recent weeks by a much larger blaze north of Denver near Fort Collins.

While no deaths or serious injuries have been reported from the blaze so far, Colorado Springs Police Chief Peter Carey said authorities were seeking the whereabouts of some people he described as "unaccounted for," though he did not give a number.

A police spokeswoman, Carrie McCuffland, said there were no specific reports from citizens of missing people, and that the unaccounted-for list consists of individuals who apparently neglected to register with the city or the American Red Cross as evacuees.

"Every indication is that there are no casualties," McCuffland told Reuters.

Authorities earlier acknowledged the loss of hundreds of homes in Tuesday's firestorm, but the damage toll released by the mayor at an afternoon news conference on Thursday gave the first firm picture of the full extent of the devastation.

President Barack Obama plans to visit Colorado Springs on Friday to meet with firefighters and tour the ravaged zones.

The grim news came as lighter winds helped firefighters battling to contain the inferno that had roared unchecked through residential neighborhoods in the northwestern corner of Colorado Springs and nibbled at the fringe of the U.S. Air Force Academy campus.

The academy welcomed over 1,000 new cadets on Thursday, despite the fire, bringing them to a portion of the facility far from the smoke, base spokesman Harry Lundy said.

For the first time since the blaze erupted on Saturday, a red-flag warning for heightened fire hazards was lifted for the Colorado Springs area.

"We had a pretty good day on the line today. There was minimal fire growth," incident commander Rich Harvey said.

But anguish and frustration ran high among many of the estimated 35,000 residents who remained under evacuation orders.

"You don't have the authority to keep me out of my house," David Dougherty, 45, a retired member of the Armed Forces, shouted out during the news conference. "I understand they're trying to save lives, but some of us don't need to be saved."

Dougherty said he believes his dwelling is still intact and wants to be let back in to the evacuation zone to secure his home and his belongings. Police reported at least one arrest for burglary in an evacuated neighborhood.

Bret Waters, the city's emergency management director, said some evacuees would be allowed to return beginning at 8 p.m. local time Thursday.

CORRALLING THE FLAMES

The Waldo Canyon blaze remained a formidable force, with fire crews managing to carve containment lines around just 10 percent of its perimeter by Thursday afternoon -- a fraction of the sprawling fire zone but still double the previous day's total, officials said.

Searing temperatures and strong, erratic winds in recent days stoked the blaze, which has burned at least 18,500 acres of timber and brush, much of it in the Pike National Forest to the west of the city that lies at the base of the famed Pikes Peak mountaintop.

Firefighters on Wednesday pushed back a spot fire in a vacant corner of the Air Force Academy, but some residential neighborhoods in and around Colorado Springs were harder hit.

"There was nothing left in some areas, burned-out foundations that were smoldering. It looked like a nuclear weapon had been dropped. It's as close to hell as I could imagine," said Bach after touring the Mountain Shadows subdivision, which bore the brunt of the destruction.

Colorado wildfires have killed four people this year in what the governor called "the worst fire season" in state history.

Earlier this month, the High Park Fire west of Fort Collins and north of Denver killed one woman while leaving 257 homes destroyed and more than 87,000 acres blackened. That blaze, ranked briefly as Colorado's most costly in property damage, was listed as 75 percent contained on Thursday.

The cause of the Waldo Canyon Fire remained under investigation, authorities said. FBI's Denver office issued a statement on Thursday saying its agents were "working closely with local, state and federal law enforcement to determine if any of the wild land fires resulted from criminal activity."

The fire menacing Colorado Springs follows a recent string of suspected arson fires in a neighboring county, but officials said they had no indication that the Waldo Canyon blaze was deliberately set.

More than 1,200 personnel, supported by heavy air tankers and helicopters, are assigned to the blaze, Harvey said.

She teamed up with contractors from the coincidentally named 180 Degrees Inc design-build company who gutted the interior, scoured their warehouse for recycled materials and carried out Lateiner?s vision.

The contractors used shipping crates stamped with ?180 Degrees? for table bases, granite from a household kitchen for tabletops, and wood doors from its warehouse stash for the auto shop?s art display, which currently features a series of photographs starring female mechanics.

For the countertop, however, Lateiner enlisted the help of local artist and friend Christine Cassano. The artist?started with slab of concrete and embedded it with a valve body transmission, several automotive gears, metal washers, aluminum rods and dark purple glass pieces. She then used a water-based concrete stain and graphite pencil on the surface.

Lateiner hopes to show the work of other local artists by rotating the displays on the art wall, adding to her already community-minded business model.

A slew of business cards dangle from the wall near the entrance and nearly all of them are local businesses whose owners or employees are customers. Lateiner says she often refers customers to them and vice versa.

?I love central Phoenix,? she says. ?People are really involved with each other?s businesses and with supporting one another. There?s this whole group of young entrepreneurs who are saying, ?This is our city and we?re gonna make it what we want.??

(AP) ? Barely four months before the nation votes, one of the biggest factors in the fight for the White House still is a mystery. That will change on Thursday.

The Supreme Court's expected ruling on President Barack Obama's sweeping federal health care law will shape the contours of the presidential campaign through the summer and fall. Both Obama and Republican rival Mitt Romney are primed to use the ruling ? whatever it is ? for political gain.

Obama expresses confidence the court will uphold his signature legislative initiative. But he won't be shocked if a conservative majority overturns the most controversial provision, those familiar with his thinking say. Romney aides say the Republican candidate will get a political boost if the court strikes down the measure. But they don't want celebrations that could alienate voters who could lose health care benefits through the decision.

Neither candidate has any direct influence over the decision. The court may uphold the health care law, strike it down or deem the requirement that most Americans carry health insurance unconstitutional while keeping other aspects in place.

The ruling is expected to be followed almost immediately by a barrage of advertisements and fundraising appeals from Democrats and Republicans, with both sides trying to cast the decision in the most advantageous light for its candidate.

Romney, running on a pledge to repeal Obama's overhaul as a costly federal power grab, has focused more than usual on the Supreme Court ruling this week. In campaign appearances in Virginia, New Jersey and New York, he offered supporters and donors a preview of his likely response to the decision.

"My guess is they're not sleeping real well at the White House tonight," a confident Romney told cheering supporters gathered Wednesday evening at a Sterling, Va., electronics manufacturer.

The night before, he told donors in New Jersey that if the Supreme Court lets the law stand, "it will make it very clear to the American people that they must elect someone who will stop it." If the high court overturns the law, "then the first three and a half years of the Obama administration will have been entirely wasted, because that's where he devoted his energy and passion," the Republican said.

Romney's campaign also is running new ads this week in Virginia, North Carolina and Iowa promising he would move to "repeal Obamacare" on his first day in office.

Obama, while recently avoiding mentioning the impending court ruling directly, has vigorously defended the overhaul as critical to the public's health and well-being in his own campaign events this week.

"I think it was the right thing to do. I know it was the right thing to do," he told supporters in Boston.

The White House also published a blog post Wednesday touting the benefits of the overhaul, including free preventive services for people on Medicare and health insurance rebates for nearly 13 million Americans.

Both Obama and Romney were scheduled to be in Washington on Thursday. Romney planned to comment on the ruling during an event on Capitol Hill, and Obama was certain to address the decision as well.

Obama advisers say the Supreme Court showed reasonableness earlier this week in a ruling on an Arizona immigration case, and they see it as a hopeful sign for how the court might rule on health care.

If the court upholds the law, Obama could get an election year gust of wind at his back, with his vision and leadership validated. If the court strikes down the overhaul, the White House would seek to cast the decision as detrimental to millions of Americans by highlighting popular elements of the law that would disappear, such as preventive care and coverage for young adults on a parent's plan.

Romney, who as Massachusetts governor signed a health care law on which the Obama's federal law was modeled, is expected to use the health care law ? or what remains of it ? as a defining issue going forward in the presidential contest, regardless of which way the court's ruling goes.

Aides say that that Romney will hold up the law either as a symbol of Obama's ineffective leadership or as federal overreach that only the Republican can stop.

The campaign has coordinated its response directly with the Republican National Committee and House Republicans, who have agreed not to "spike the ball" ? as one Republican put it ? should the law be struck down. Romney's campaign worries that an over-celebratory tone may turn off voters affected by the decision.

Still, both sides will use it to raise money and motivate supporters. The Democratic Congressional Campaign Committee issued a fundraising appeal for a "health care rapid response fund," telling supporters in an email Wednesday that however the court rules, "Democrats are in for a tough fight."

A flood of advertisements is also expected from outside groups. The conservative group called Concerned Women for America pre-emptively launched a six-state, $6 million advertising campaign this week claiming Obama's overhaul results in delayed and denied care, as well as skyrocketing costs.

?A plant sees what we see. A plant sees light.?

Daniel Chamovitz, director of the Manna Center for Plant Biosciences at Tel Aviv University and author of the new book What A Plant Knows.

?So if you take someone who?s completely blind and by surgery in some way giving them a camera, allow them to see just shadows, would we see that that person now has rudimentary sight? He doesn?t see pictures, but for that person being able to differentiate shadows is definitely sight. If we would let them be able to differentiate between red and blue, then that would be even slightly more sight.

?That?s what plants do. They don?t see pictures. But they see colors, they see directions, they see intensities. But on a certain level, plants might think that we?re visually limited. Because plants see things that we can?t see. They see UV light and they see far red light, and we can?t see that at all. So I think we can say that plants see. It knows quite a bit, much more than we give them credit for.?

(AP) ? Outfielder Marlon Byrd was suspended 50 games by Major League Baseball on Monday after testing positive for a performance-enhancing substance.

Major League Baseball said the 34-year-old Byrd tested positive for Tamoxifen, which can reduce side effects of steroid use and increase testosterone. It is often used to treat breast cancer patients.

"I made an inexcusable mistake," Byrd said in a statement released by the players' association. "Several years ago, I had surgery for a condition that was private and unrelated to baseball. Last winter, I suffered a recurrence of that condition and I was provided with a medication that resulted in my positive test. Although that medication is on the banned list, I absolutely did not use it for performance enhancement reasons."

Byrd is currently a free agent, and will be placed on the restricted list for the duration of his suspension, which began immediately. He started the season with the Cubs and was dealt to the Red Sox on April 21. He was designated for assignment by Boston on June 9 and released four days later.

"I am mortified by my carelessness and I apologize to everyone who loves this game as I do," Byrd said. "I will serve my suspension, continue to work hard and hope that I am given an opportunity to help a Club win later this season."

In 2009, Byrd said he was using supplements provided by SNAC System, a company founded by Victor Conte, who also was the founder of the Bay Area Laboratory Co-Operative.

BALCO was at the center of a wide-ranging scandal involving performance-enhancing drugs that enveloped several top-level athletes, including Marion Jones, Tim Montgomery and Barry Bonds. Conte pleaded guilty to steroid distribution in July 2005 and served four months in jail.

Byrd said the supplements were all OK to use under MLB rules. He had never before been suspended for failing an PED test.

"Any nutritional supplements I ever provided to Marlon Byrd were legal products that contained no banned substances," Conte wrote on Twitter. "I provided Marlon Byrd with nutritional and training advice which had nothing whatsoever to do with any type of prohibited substances."

In an email to The Associated Press, Conte said he still supports Byrd.

"Marlon Byrd is a terrific person and did not use a drug to cheat," Conte said in his email. "Look at his numbers this season, the worst of his career. Traded and then cut. I was not aware of his medical condition. Marlon is my friend and I will always have his back."

Byrd hit .210 in 47 games with the two teams, though he hit .270 with a homer and seven RBIs in 34 games with Boston. The Red Sox picked him up when they had a shortage in the outfield after a rash of injuries.

"He played here and he played well," Red Sox manager Bobby Valentine said. "I had no indication or I don't think anyone did."

The 34-year-old Byrd has played for five teams in 11 major league seasons and is a career .278 hitter.

Byrd finished fourth in the National League Rookie of the Year voting in 2003 with the Phillies and was a National League All-Star with the Cubs in 2010.
