Judge clearing path for campaign finance probe into Arizona group ...

Ann Ravel is chairwoman of the California Fair Political Practices Commission. A state judge in Sacramento appears ready to side with California's campaign finance watchdog in its effort to unmask the donors behind the Arizona nonprofit that donated $11 million to state campaigns earlier this month.

The judge issued a tentative ruling in the case Tuesday afternoon, one day before lawyers for the state and the Arizona nonprofit are scheduled to face off in court.

In the ruling, Superior Court Judge Shelleyanne W.L. Chang said the Fair Political Practices Commission can demand a variety of records to show whether the nonprofit was improperly shielding its donors' identities.

Chang did not say whether the nonprofit, Americans for Responsible Leadership, will eventually have to publicly disclose who its donors are. California regulations say donors must be identified if they gave to nonprofits with the intention of spending money on state campaigns here.

Americans for Responsible Leadership gave the $11 million to the conservative Small Business Action Committee, which is fighting Gov. Jerry Brown's tax-hike campaign and pushing a ballot measure to curb unions' political influence.

Without conducting an audit of the nonprofit, Chang said, Californians could suffer "irreparable harm" because voters may not get information critical to deciding how to vote on those issues.

The Arizona nonprofit has criticized the request for records as politically motivated and said it has a 1st Amendment right to keep its donors secret.

In its own court filing, the Fair Political Practices Commission said the Arizona group's defenses "are frivolous and grossly misstate California law."

The commission also denied that it was probing the group because of political pressure, saying the unusual circumstances surrounding the donation prompted its request for records.

Iran pulls back from nuclear bomb goal: Israeli defense minister

LONDON (Reuters) - Iran has drawn back from its ambitions to build a nuclear weapon, Israel's defense minister was quoted as saying on Tuesday, while warning that his country may still have to decide next year whether to launch a military strike against it.

Tehran denies its nuclear work has any military dimensions but governments in Europe and the United States are increasingly concerned over its intentions.

Diplomacy and successive rounds of economic sanctions have so far failed to end the decade-old row, raising fears of Israeli military action against its arch-enemy.

Defense Minister Ehud Barak told Britain's Daily Telegraph newspaper that an immediate crisis was avoided when Iran chose to use more than a third of its medium-enriched uranium for civilian purposes earlier this year.

He told the paper that the decision "allows contemplating delaying the moment of truth by eight to ten months".

"There could be at least three explanations. One is the public discourse about a possible Israeli or American operation deterred them from trying to come closer," he said.

"It could probably be a diplomatic gambit that they have launched in order to avoid this issue culminating before the American election, just to gain some time. It could be a way of telling the IAEA (International Atomic Energy Agency) 'oh we comply with our commitments'."

Analysts say Iran already has enough low-enriched uranium for several nuclear bombs if it were refined to a high degree, but may still be a few years away from being able to assemble a missile if it decided to go down that path.

Western diplomats say Iran appears to have nearly finished installing centrifuges at an underground nuclear plant, potentially boosting its capacity to make weapons-grade uranium if it chose to do so.

Asked by the British newspaper whether, if Iran had not pulled back, the crisis would have peaked "about now", Barak said: "Probably yes". He added however that he believed Iran was still resolved to build nuclear weapons.

"We all agree that the Iranians are determined to turn into a military nuclear power and we all share the declaration that we are determined to prevent Iran from turning nuclear and all options are on the table," he was quoted as saying.

"We mean it - we expect others to mean it as well. So it's not something just about us. But we, for obvious reasons, see the Iranian threat in much more concrete terms."

He said Israel reserved the right to act alone.

"When it comes to the very core of our security interests and, in a way, the future of Israel, we cannot delegate the responsibility for making decisions even into the hands of our most trusted and trustworthy ally," he told the Telegraph.

"It doesn't mean that we would be sorry if the Iranians come to the conclusion on their own. The opposite is true. But, if no one acts, we will have to contemplate action."

SpaceX Dragon to leave space station Sunday

The private Dragon spacecraft is set to return to Earth Sunday, wrapping up the first-ever commercial cargo mission to the International Space Station.

The unmanned Dragon capsule, built by the California-based firm SpaceX, is scheduled to undock from the orbiting lab at 7:55 a.m. EDT (1155 GMT) Sunday, then be released by the station's huge robotic arm about 90 minutes later.

If all goes according to plan, Dragon will splash down in the Pacific Ocean off the California coast at 3:20 p.m EDT (1920 GMT) Sunday, where SpaceX personnel will retrieve it with a crane-equipped boat. You can watch the Dragon's undocking live on NASA TV here beginning at 7 a.m. EDT (1100 GMT).

Dragon launched atop SpaceX's Falcon 9 rocket on Oct. 7, kicking off the first of 12 robotic supply flights the company will make for NASA under a $1.6 billion contract. The capsule arrived at the station three days later, delivering 882 pounds of supplies and scientific experiments.

Dragon will bring 1,673 pounds of cargo back down to Earth Sunday, including 866 pounds of scientific research gear, NASA officials said.

NASA is looking to American companies such as California-based SpaceX to fill the crew- and cargo-carrying void left by the retirement of the space shuttle fleet in 2011. The agency also signed a $1.9 billion deal with another firm, Virginia-based Orbital Sciences Corp., to make eight unmanned supply flights with its Antares rocket and Cygnus spacecraft.

Orbital plans to test-fly Antares for the first time later this year. Meanwhile, Dragon's second official supply mission is slated to blast off in January. That flight will actually mark Dragon's third visit to the space station; it first docked with the orbiting lab in May of this year during a historic demonstration mission.

SpaceX is also working to develop a manned version of Dragon, in the hopes of winning a NASA contract to ferry astronauts to and from the space station. The company has said it may be ready to carry crews by 2015 or so.

Three other firms ? Sierra Nevada, Boeing and Blue Origin ? have also received NASA funding in the last two years to develop crewed vehicles. NASA hopes at least two of the four companies have manned spaceships up and running by 2017.

The Google Penguin Upate and Article Marketing | The Board ...

Many article marketing strategies have been ruined by the effects of the Google Penguin update. What?s the point of writing and submitting articles if they are going to be ignored? Even asking that question displays an ignorance of the Penguin update, and the fact that many people do not know to use it their advantage.

Yes ? opportunities! By understanding why the Google Penguin update has been thought necessary, that knowledge can be used to beat your competitors. I have outline below what I feel the Penguin update is trying to achieve, and how you can design your article marketing strategies around that.

1. Multiple Backlink Sources

The Problem: The Penguin update will analyze the sources of you backlinks, and will be looking for a variety of sources. Not just lots of article directories, but from other sources such as social bookmarking sites, social networking pages and other websites, blogs and forums. Squidoo can also be used, an in spite of all you read about this site using the no index, nofollow attributes, my own links on my lens do not contain these an I have seen Squidoo pages listed in my linking analysis.

The Solution: You can help yourself to satisfy Google Penguin by not only submitting articles to multiple directories, but also by publishing your links on various other online publications. Use PDF links, such as Scribd, create a Facebook page about you niche, run a static website and a blog, not just one or the other, and also submit your links to as many social bookmaking an networking sites as you can. You can find many more online, but it is not the intention here to offer lists but provide information and advice.

2. Multiple Anchor Text Links

The Problem: If you run a website or blog focusing on the keyword ?my blog,? then expect to be punished if all your anchor text is ?my blog? and all the links lead back the the ?my blog? home page..? The Penguin update has been programmed to find different forms of clickable anchor text.

Over the years, Google algorithms have evolved to offer more weighting to links from authority sites than to content farms and article directories. It is not surprising, therefore, that the requirement for diverse backlink sources and numerous forms of anchor text has affected so many listing positions (or SERPs ? search engine result positions.)

The Solution: One of my websites was situated happily at #1 on Google for its main keyword for over 36 months ? after the Penguin update it was not mentioned at all in the top 100 Google results for its main keyword. I know the home page was indexed because I could find it on my browser, but it was unlisted because I neglected creating a variety of backlink sources and anchor text ? they were restricted to article directories in the main, and then only a few of the major publications.

Visits dropped from 50,000 monthly to 4,000. I have now fixed that, not only by expanding the sources of backlinks, but also by using as many variants of anchor text as I could, and the home page SERP is now slowly recovering.

3. Multiple Landing Pages

The Problem: Most people include their home page as the landing page in their links, and no other. What the Google Penguin update is seeking is a much broader range of web pages receiving your backlinks, and 20 links to a single page is regarded as significantly inferior to 20 links split between 20 pages..

The Solution: Make your links to the pages on your website that most closely relate to the topic of the article. Generate social bookmarking links to multiple pages on your website, and write articles about various facets of your niche: you can link these articles to the page on your site most appropriate to their topic.

There is a lot more. Keep your keyword density to a minimum ? less is best according to Penguin that appears to use LSI more than keyword repetition. 3% KD? Too much! Additionally, create a number of different types of presence on the web and link them together: authority websites, blogs, mini-sites, lenses, SBI sites ? all of this attracts traffic, and that is what you are trying to achieve!

Avoid article spinners ? Google is hunting these down ? and the original writers are doing the same. Write your own or employ ghostwriters. Everything mentioned above is essential if you want the best results online, and if you follow that advice and design effective article marketing strategies, you should have no problems with the Google Penguin update..

It's been a long time coming, but this week finally sees the release of the Amazon Kindle Fire in the UK and selected markets across Europe. With prices starting at just £129 for the cheapest version, there is huge potential for Amazon to capture the casual tablet buyer market. 7-inch tablets are great for consuming media, no doubts. The Google Nexus 7 could be seen as a direct competitor, but there are differences, and there are areas where Amazon has a slight leg up on Google. And, it's all to do with content. 

In the US, Nexus 7 owners can watch movies and TV shows, read magazines and books, and buy music. In the UK, we're limited to just the movies and books offerings, which to this day still disappoints. Yes, there's nasty licensing issues to deal with, but Amazon has done just that. We've had the MP3 store for a few years now, along with the Kindle offerings. In recent weeks though, Amazon has opened up the Appstore, Cloud Drive and Cloud Player, and has revealed how their LOVEFiLM rental service will be baked into the Kindle Fire to provide the video content. 

So, is this the content consumers tablet of dreams? Maybe, it's had success in the United States, and Amazon is a well known, well trusted brand on these shores. But, just how good is the content that Amazon is offering up to UK customers? Lots of things look good on paper and then fail to stack up in reality. 

The good news for you guys out there is that we've got one. A UK Kindle Fire landed on our doorstep, so we've opened it up and taken a very quick first look. We've got the standard Kindle Fire, the 8GB, £129 version, and first impressions are pretty positive. The hardware is nice -- if a little chunky -- and while frustrating at times, the Amazon software is nice to look at and easy to navigate.

Baseball-Pitch counts don't add up to more injuries, says study

NEW YORK, Oct 26 (Reuters Health) - It is impossible to watch a Major League Baseball (MLB) game nowadays - such as those in the World Series now underway - without hearing about how many pitches a player has thrown.

But a new study suggests that when it comes to preventing injuries, the obsession of many teams with those kinds of numbers may be misplaced.

"I don't necessarily think that pitch counts or innings pitched are the best way to measure the demands of pitching," Thomas Karakolis, the lead author on the study, told Reuters Health.

Karakolis, a PhD candidate at the University of Waterloo in Canada, and two colleagues looked at data from every MLB pitcher from 2002 to 2007, focusing on a given year's pitch count, innings pitched and whether the player ended up injured the following year.

In that second year, more than a quarter of major league pitchers spent time on the disabled list. That rate jumped to nearly two in five pitchers for those who tended to throw six or seven innings.

But that difference - which would seem to support the idea of using pitch counts and innings pitched to pull pitchers - was more than likely due to chance, Karakolis said.

The injuries were significant enough that disabled list players were out for an average of 78 days - more than a third of the annual baseball season.

"If we can't predict injuries based off of these metrics, how are we going to use them to prevent injuries?" asked Karakolis.

Perhaps the most famous case is Stephen Strasburg of the Washington Nationals, whose managers made it clear at the beginning of this year's season, following surgery in 2010 and less than a month of play in 2011, that he would be allowed to pitch only 160 innings.

They shut him down after 159 and a third innings, meaning he was unavailable to play in the Nationals' first-ever playoff appearance in nearly 80 years.

Strasburg did not debut in the majors until 2010, so his data are not included in the research, which is published in the Journal of Strength and Conditioning Research.

"The Karakolis study indicates that Strasburg faced very little danger from continuing to pitch," said J.C. Bradbury, of Kennesaw State University in Georgia.

The Nationals declined to comment.

Bradbury, who was not involved in the new study, published research earlier this year showing that pitch counts did seem to have a real effect on performance, but so small as not to be practically relevant.

TODAY'S PITCHERS VS. YESTERDAY'S

Because of the pitch count obsession, such numbers have been falling for more than two decades, Bradbury told Reuters Health by email.

"In the late 1980s and early 1990s, the maximum number of pitches you'd see a pitcher throw would be in the 160s. Now that maximum is normally in the 130s," Bradbury said.

Although excessive pitching can obviously lead to injury, he added: "The relevant question is, can we say that cutoffs at 90, 100, 110, etc. are safer than each other? I don't think there is any evidence (for that)."

Another factor in the mix is pitches and workouts on off days - often 30-40 pitches a few days after each start, plus strength training - which are not reflected in game-day pitch counts, said Karakolis.

One of Karakolis's co-authors, Ryan Crotin, pointed out that some of the strain on pitchers is emotional and psychological, and would not show up in typical measures.

For their stress hormone-producing adrenal glands, said Crotin, who works with the Baltimore Orioles, it's "almost like they've run a marathon".

Karakolis said that pitch counts and innings pitched were "definitely part of the future but on their own they're not going to be effective".

He suggested that teams might look into a "piggy back" system such as that used in the minor leagues, in which pitchers do not throw more than 75 pitches before being taken out of the game, and rotate between starting and relieving.

But he is clear that the data are "not conclusive yet, and I don't have any idea how that would affect performance". His study only looked at injuries.

Bradbury agreed that baseball needs better metrics.

"There have been many studies on youth pitchers that find pitches thrown are correlated with injury," he said.

"However, very little work had been done on adults or professionals, and there are many reasons to expect the impact will differ between children and adults." (Editing by Frederik Joelving and Mark Lamport-Stokes)

Walker starts Barclays board clean-up: FT

LONDON (Reuters) - Sir David Walker plans to overhaul of Barclays' board after he formally becomes the bank's chairman on November 1, and he will oversee the replacement of executives, the Financial Times reported on Thursday.

Walker has made clear in remarks since being appointed in August that he also plans to change some of the bank's non-executives and work closely with new Chief Executive Antony Jenkins to improve culture across the bank.

He is set to replace most non-executives over the next six to 12 months and has approached some of senior City of London figures.

Some of those approached regarding board positions include the former Lloyd's of London chairman Lord Levene, and Lord Davies, the former chairman of Standard Chartered .

Others approached for unspecified roles at the bank include Colm Kelleher, the European head of Morgan Stanley , and Jonathan Moulds, the former European head of Bank of America Merrill Lynch .

Outgoing chairman Marcus Agius, former chief executive Bob Diamond and former chief operating officer Jerry del Missier all resigned in the summer, following the Libor rate-rigging scandal that engulfed the bank and led to a 290 million pound ($464.86 million) settlement with regulators.

Barclays has started the search for a new head of human resources to replace Sally Bott, who resigned with immediate effect on Friday, 18 months after joining the British bank.

The FT reported that the reshuffle could include a new finance director to replace Chris Lucas, who has been unwell for some time and is expected to retire next year.

Some investors also expect Rich Ricci, Barclays investment banking head, to be replaced given his close associations with the previous regime and Diamond in particular, according to the FT's report.

This is the dramatic moment a major rescue operation began after a helicopter carrying 19 oil rig workers ditched in the sea.

Photographs of the Super Puma helicopter being kept afloat off the coast of Shetland were released for the first time today after every man was helped to safety.

Rescuers then faced a race against time to lift the aircraft into a recovery vessel before it sank.

Flotation bags had been fixed to the bottom of the helicopter, but they could only hold it up for a short period.

The aircraft was successfully loaded on to anchor-handling tug supply vessel, the Olympic Zeus, today and the vessel was on its way back to the mainland, due to arrive at Peterhead at 3.30am on Wednesday.

The helicopter, operated by Aberdeen-based CHC Helicopters, made an emergency landing in the sea 14 miles west of Fair Isle, between Orkney and Shetland, at about 3.30pm on Monday.

It landed about 200 metres from a ship, the Nord Nightingale, which was taking a cargo load of diesel on its way from Primorsk in Russia to Belfast in Northern Ireland.

The ship's crew went to help the oil rig workers and brought them onboard the vessel.The men were flown back to Aberdeen today.

The ship's master, Bo Rosenborg, said: 'My officer on duty alerted me to the emergency landing.

'It was very close to our ship, maybe about 200 metres behind it.

'We reduced our speed and turned around as quickly as we could and contacted the Shetland coastguard.

'It was agreed that we would try to commence the rescue operation. It was very exciting, we were all keen to see if everyone was okay.

'Once the operation got under way, everyone was calm and focused.

'We agreed to try and get the crew on board and sent out a rescue craft.

'We managed to bring all 19 passengers on to the vessel, where they were then transferred to two rescue helicopters.

'We were lucky that the weather was good, which made things easier for us. Thankfully, the controlled landing was so good that there were no injuries.'

Investigators from the Air Accidents Investigation Branch are expected to interview the helicopter's two pilots about the incident.

The Helicopter Safety Steering Group will also discuss the matter at a meeting on Wednesday.

Offshore carriers have grounded their fleets of Super Puma helicopters following the emergency.

The incident has concerned unions representing offshore workers, who today said there was 'growing fear' among members about helicopter safety.

The Unite union wants to ban the use of the 'Dacon Scoop', a net and winch device for rescuing people from the water.

Unite industrial Officer John Taylor said: 'We go into this emergency meeting of the HSSG with serious concerns about whether these aircraft are fit for purpose and to make clear our members growing fears over wider safety procedures for offshore helicopter rescue, particularly where the rescue fall-back plans involve the use of the Dacon Scoop.

'It's unacceptable to Unite and our members that helicopters should be allowed to fly where conditions are deemed so hazardous that being fished-out of the sea by a mechanical device from a rescue vessel is the last line of safety.

'Mercifully there were no fatalities with this latest incident, largely due to the skills of the pilot crew, the close proximity of the Nord Nightingale tanker in the waters off Shetland and the elements.

'They were lucky but we can't always rely on luck and we need to tighten-up industry safety standards now.'

It is the second time in seven months that the crew of the Nord Nightingale has been called out on a sea rescue.

In March it helped an injured competitor who had been taking part in the Clipper 09-10 Round the World Yacht Race.

He suffered serious head cuts after being hurled across the cabin during severe storms in the middle of the Pacific.

The Nord Nightingale, which was in the area at the time, took him on board where he was treated for his injuries.

The yachtsman's teammates then continued the race.

It's not quite what we expected, but Apple has just introduced us to a new, 4th generation iPad at its event in San Jose, California today. It's essentially a hardware refresh for Apple's 3rd gen slate, as it packs new A6X silicon with quad-core graphics that the company claims provides double the performance of the old A5X chip. The new iPad also gets dual-band 802.11 a/b/g/n WiFi, expanded LTE compatibility (including Sprint and KDDI), a 720p FaceTime camera on the front and the new image processor first seen in the iPhone 5. Of course, it also gets the reversible Lightning port that debuted on on the iPhone, and will be available in both black and white. Pricing stays the same as its predecessor, with a 16GB WiFi version for $499 and a 16GB model with cellular data on board costs $629. Interested? You'll be able to pick one up through Apple's online and brick and mortar stores or Apple Authorized Resellers in a host of countries -- listed in the PR after the break -- on November 2nd.

Last minute Fall decor for your home

This fall season sneaking up on you? There?s still time to get in your spirit and dec your home out with some simple crafts that are more creative than jack-o-lanterns or store-bought scares. But you love pumpkins you say? Check out last week?s Vox coverage of creative ways to decorate your favorite gourds without the mess!

1. Some Simple ghosts: These creative creatures are perfect to stick in your yard, in a vase or just around your home. Put them under a vent or in the wind to watch them move.

Supplies- Small white trash bags, Marshmallows*, thin dowel rods, string, a Sharpie.

  • Stick a marshmallow onto a dowel rod.
  • Cover the marshmallow with an opened up white trash bag.
  • Tie a string around the bag at the bottom of the marshmallow and make a knot.
  • Draw a face with a Sharpie.

*Note: If you?re putting your ghosts outside, consider something other than a marshallow. Perhaps a cotton ball.

2. The edible decoration: Here?s a treat that you won?t have to worry about cleaning up when winter comes around. They will surely disappear on their own.

Supplies- Pretzel rods, meltable chocolate in a variety of colors, wax paper, fun and festive sprinkles.

  • Melt the chocolate. I suggest buying milk chocolate, white chocolate and orange colored chocolate to end up with a flattering platter.
  • Dip the pretzels in the chocolate and roll them in sprinkles.
  • Let them dry on wax paper in the fridge for 30 minutes
  • Arrange them nicely on a platter and serve to your friends.

3. A spooky classic: This quick trick is a tradition for all the best decorated houses. And it?s not even that hard to do. Those tricksters!

Supplies: a bag of webbing from any craft store, Scotch tape.

  • Take your webbing and pull it apart until it looks thin but not breakable.
  • Tape the edges to a balcony or door to create a spooky spider web effect.
  • Or ditch the tape and hang them in your trees or bushes.

4. Not to scary shadows: The perfect touch to any home for when the lights go out. This crafty creation is perfect for any home, apartment or dorm room.

Supplies: Medium sized pieces of cardboard, an exact o knife and cutting board of sorts, Scotch tape, candles (real or fake).

  • Use your exact o knife to cut a festive shape out of card board.*
  • Attach the wire to the back of the cardboard cut out and stick the other end of the wire into the wax of the candle so that the cut out sits about 8 inches above the candle. If you?re using a fake candle just use tape to attach both ends of the wire.
  • Place the creation near the wall and watch the shadows dance along it.

*You can use regular scissors, but the exact o will be easiest if you have inside pieces you want to cut out to add to the shape.

5. A band of life-sized witches: This is not for the faint at heart. But if you?re in the mood to craft and have some yard space, this is for you. You?ll surely be the coolest house on the street.

Supplies: 6 witch hats (I suggest a dollar store), 6 stakes, 6 black table cloths, some string, 6 large pieces of styrofoam (preferably spherical).

  • Place the 6 stakes in your yard in a fairly large circle.
  • Stick the styrofoam onto the top of the stakes.
  • Cover each piece of styrofoam with a black table cloth so that the styrofoam is completely covered and the cloth hangs off the stake like a cape.
  • Tie the tablecloth around the stake and cloth to hold it in place.
  • Tie the ends of each table cloth to each other so it looks like the witches are holding hands.
